Gifts of Land

Triangle Land Conservancy accepts gifts of land or interest in land (also known as conservation easements) and other real estate for several different purposes, including:

  • to create nature preserves
  • to protect valuable farmland and forestland
  • to sell for funding to protect important natural areas

Natural Lands

Peg Parker dips her hand in the Rocky River at Wood's Mill Bend, the natural area she donated to TLC Many area landowners have made outright, fee simple donations of important natural lands to Triangle Land Conservancy. TLC establishes those lands as nature preserves and provides on-going stewardship to ensure that the property's natural value is maintained. Examples of properties donated to TLC include Wood's Mill Bend, Condoret Nature Preserve, McCauley Mountain, Montgomery Laurel Bluffs, Second Island, The Rocks, Pegg Hill, Temple Flat Rock, Chanlett Tract (George's Creek), and Middle Creek Bottomlands I & II.

Conservation Easements

Ken Winter with his llamas, Lewis (right) and Clark, at Rocking Horse Farm, on which he donated a conservation easement to TLC Landowners can donate an interest in their land, typically the development rights, while they continue to own and use the land. This is known as a conservation easement.

TLC holds conservation easements to protect the conservation value of private property. A conservation easement is a legal agreement between a landowner and TLC tailored to meet the landowner's needs and to ensure conservation value. Landowners promise to keep the land in its natural conditions, and TLC is required to monitor the property and enforce the terms of the easement if need be. Owners of working landscapes—farms and timberland—are allowed to continue farming or timbering, using best management practices.

The conservation easement is attached to the deed for the property and stays with the deed even when the land is sold, transferred or passed down to heirs, with all future owners bound by the terms of the conservation easement. Landowners can take advantage of income tax incentives provided at both the state and federal levels, and the donation of a conservation easement can also play a role in reducing the value of an estate for inheritance tax purposes.

Examples of properties TLC has protected with donated conservation easements include Buffalo Creek Cypress Swamp, Coffer Forest, Holding Farm, Johnson Homestead, Kuenzler Wildlife Habitat Preserve, Lloyd-Andrews Historic Farmstead, Maple View Farm, Montrose, , Pickard Mill, Seilkop Forestland, Summers Farm, Theys Farm, and Rocking Horse Farm.

Trade Lands

In addition to accepting gifts of natural land, Triangle Land Conservancy welcomes gifts of other types of real property like single-family homes, vacation homes, apartment buildings, commercial property, undeveloped land and vacant lots. We call these gifts "Trade Lands" because after you donate your debt free and readily marketable property, we sell it and use the proceeds to help fund efforts to protect and preserve natural areas in our region. These gifts can provide you with significant tax and financial advantages.

Example: Steve & Judy no longer had a need for their second home that had appreciated in value over the years. They donated it as a "Trade Land" to TLC. When we sold the home, it provided vitally needed funds to protect special places in our region. Steve & Judy received an immediate income tax charitable deduction (equal to the market value of the property) and greatly appreciated the tax savings.
